Terms of Service

By accessing or using Giveaway Picker App (“the Service”), available at giveawaypicker.app, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and Giveaway Picker App (“we,” “us,” or “our”). Please read them carefully before using the Service.

Giveaway Picker App is a social media comment raffle and giveaway tool. The Service allows users to randomly select winners from comments on public Instagram posts and Reels.

The Service fetches publicly available comments from posts, applies optional filters (such as deduplication), and selects winners using a random selection process. The Service operates on a read-only basis and does not post, comment, or interact with social media platforms on your behalf.

• You must provide a valid email address and create a password to register an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.
• You must be at least 13 years of age to create an account and use the Service.
• Account registration applies to the web Service only. The Giveaway Picker mobile app requires no account and no email address; it operates anonymously per device.

Free Plan

Giveaway Picker App offers a free tier. Without an account you may run one raffle per day (per 24-hour period) from the landing page, fetching a limited sample of comments. A free account does not include raffle runs of its own: once you are signed in, running raffles requires an active Pro subscription. No payment details are required to use the free plan.

Pro Subscription

Pro is a paid subscription priced at $9.99 per month, billed in advance on a recurring monthly basis. It removes daily limits, scans far more comments per post, supports up to five winners per draw, and includes priority email support. Prices are listed in U.S. dollars and are inclusive of any applicable sales tax, VAT or GST — the price you see at checkout is the total you pay, with no tax added on top.

Seller of Record

Payments for the Pro subscription are processed by Stripe (Stripe, Inc. and its affiliates) through Stripe Managed Payments. Stripe is the seller of record for your purchase: Stripe sells the subscription to you in its own name, collects and remits any applicable sales tax, VAT or GST in its own name, and appears as the merchant on your card or bank statement. Stripe issues your invoices and receipts in its own name, and may issue refunds directly for up to 60 days after a charge. All prices shown are tax-inclusive, so no tax is added to the advertised price. Stripe processes and stores your card details on PCI-compliant infrastructure; we never receive or store your full card number. You can review Stripe's privacy policy on their website.

Billing

By subscribing to Pro, you agree to the following billing terms:

• All payments are processed securely through Stripe using PCI-compliant infrastructure.
• Your subscription auto-renews at the end of each monthly billing period unless cancelled.
• You may cancel at any time from your account (Manage Subscription) or by contacting us.
• Cancellations take effect at the end of the current billing period, after which your account automatically reverts to the free plan.
• Refunds, including our 14-day money-back guarantee, are governed by our Refund & Cancellation Policy.
• If a payment fails, your account may enter a grace period. You must update your payment method to maintain access to Pro features.

We may change plan pricing or features with prior notice. From time to time we may offer premium features free of charge during promotional periods, in which case no payment is required.

Mobile App Subscriptions (App Store)

If you subscribe through the Giveaway Picker mobile app, payment is charged to your Apple App Store account at confirmation of purchase. The subscription renews automatically unless auto-renewal is turned off at least 24 hours before the end of the current period; your App Store account is charged for renewal within 24 hours before the current period ends. You can manage or cancel the subscription at any time in your device's App Store subscription settings (Settings → your name → Subscriptions); deleting the app does not cancel the subscription. The Stripe billing terms above apply to web purchases only and do not apply to purchases made through the App Store.

By using the Service, you agree to:

• Use the Service only for lawful purposes and in compliance with applicable laws and regulations.
• Only run raffles on posts you own or have explicit permission to use for a giveaway.
• Comply with the terms of service of the social media platforms from which comments are fetched.
• Genuinely intend to award prizes as described in your giveaway posts.
• Not use the Service in any way that could damage, disable, or impair the Service.
• Not attempt to gain unauthorized access to the Service or its related systems.
• Not use the Service to scrape, harvest, or collect data beyond the intended raffle functionality.

Giveaway Picker App is an independent service and is not affiliated with, endorsed by, or sponsored by Instagram, Meta, or any of their parent companies. All platform names, logos, and trademarks are the property of their respective owners.

You are solely responsible for ensuring that your use of the Service complies with each platform’s terms of service, community guidelines, and any applicable promotion rules or policies.

• Winners are selected using a secure random selection process on our servers to ensure fairness.
• Deduplication can be applied so each unique user is counted only once, regardless of how many comments they leave on a post.
• For posts with a very large number of comments, the Service fetches a representative subset rather than all comments. This means not every comment may be included in the selection pool for extremely large posts.
• While we strive for maximum fairness, we cannot guarantee that the selection process is perfectly unbiased in all cases due to the nature of social media data retrieval.

The Service, including its design, code, features, and content (excluding user-generated content and third-party social media data), is owned by Giveaway Picker App and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

We do not guarantee the accuracy, completeness, or availability of social media data. Social media platforms may change their systems, restrict access, or modify data availability at any time without notice to us.

To the maximum extent permitted by law, Giveaway Picker App shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Our total liability for any claims arising from or related to the Service shall not exceed the total amount of fees you have paid to us in the twelve (12) months preceding the claim.

You agree to indemnify and hold harmless Giveaway Picker App and its affiliates, officers, agents, and employees from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any third-party rights, including social media platform terms of service.

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause and with or without notice. You may terminate your account at any time by contacting us.

Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination shall remain in effect, including but not limited to intellectual property provisions, disclaimers, limitations of liability, and indemnification.

These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the “Last updated” date. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.
